Prestation:
*L’exposant s’engage à proposer à la vente uniquement les produits/services mentionnés dans son dossier de candidature et validés par l’organisateur.
*L’exposant n’est pas autorisé à vendre des boissons sauf avis express et notifié par l’organisateur.
*Tous les emballages, vaisselles et contenant utilisés par l’exposant durant la prestation doivent être à usage unique (sauf les gobelets consignés) et biodégradable. L’exposant s’engage à valoriser et minimiser les déchets qu’il engendre sur l’espace.
*Aucune sonorisation ne peut être apportée par les exposants, sauf autorisation écrite par l’organisateur. Dans ce cas tout frais à charge de l’exposant (droit d’auteur, …).
*Par respect envers le public, les exposants doivent assurer le service pendant toute la durée du Festival.
Emplacement:
Lors de l’installation le jour de l’évènement, les emplacements seront attribués selon l’avis de l’organisateur et l’exposant est tenu de respecter les consignes pour ne pas perturber le bon déroulement de l’installation.Les emplacements qui n’auront pas été occupés à la clôture de l’installation du premier jour pourront être attribués à tout autre exposant sans que le signataire du présent engagement de participation puisse requérir le remboursement du montant de sa participation ou une quelconque indemnité.
Contrôles:
L’exposant peut faire l’objet de contrôles (police, pompiers, afsca,..).
Les consignes de ses contrôles doivent être immédiatement respectées.
L’organisateur peut également faire des contrôles concernant le respect des règles et des consignes acceptés par l’exposant.
En cas d’infraction des sanctions peuvent être infligées par l’organisateur (cf. § sanctions).
Il appartient à chaque exposant d’accomplir les formalités douanières pour les matériels et marchandises en provenance de l’étranger, ainsi qu’en matière de TVA locale et d’autorisation de vente. L’organisateur ne peut être tenu responsable des difficultés pouvant en résulter.
Surveillance & sécurité:
Durant les heures d’ouverture et lors de l’installation et du démontage l’exposant est responsable de la surveillance de son matériel. Il s’engage à être présent dès l’ouverture et jusqu’à évacuation complète des lieux du festival.
L’exposant est tenu de prendre connaissance et de respecter les mesures de sécurité imposées par les autorités publiques et celles prises par l’organisateur.
De même l’exposant est tenu de respecter scrupuleusement les mesures d’ordre intérieur à la manifestation ou toute mesure de police prescrite non seulement par l’organisateur, mais par toute autre autorité compétente.
L’organisateur, son personnel ou les autorités compétentes (police, pompiers, afsca, …) se réservent le droit de suspendre à tout moment la participation de l’Exposant et de lui retirer ses accès s’il devait ne pas être en conformité avec l’un ou l’ensemble des articles des présentes Conditions Générales.
Nettoyage:
L’exposant est tenu d’assurer le nettoyage de son emplacement. au démontage il sera également tenu de laisser un espace vide de tout encombrant, y compris des poubelles, et propre!
Électricité:
L’exposant dispose d’un accès à un branchement électrique – par défaut 1x 220V 16A max 3000w et situé à moins de 50m de son emplacement. Il s’agit d’une obligation de moyen et non de résultat.
L’exposant est responsable de son raccordement (câble et adaptateur). Un contrôle aura lieu par un électricien pour la conformité du matériel!
Tout appareil électrique ou à gaz utilisé par l’exposant doit satisfaire aux normes en vigueur.
L’organisateur ne peut pas être tenu responsable des coupures électriques qui pourraient survenir.
Assurances:
Les exposants sont tenus d’assurer le matériel, le mobilier et les marchandises qu’ils exposent et de souscrire un contrat en responsabilité civile, avec intoxication alimentaire pour la durée de la manifestation, livraison, installation et démontage compris.
L’organisateur décline toute responsabilité pour les dommages ou pertes, ainsi que pour les vols ou disparitions de matériel appartenant aux exposants.
Sanctions:
Le non-respect des clauses du présent règlement pourra entraîner à la seule volonté de l’organisateur, même sans mise en demeure, l’exclusion immédiate (temporaire ou définitive) de l’exposant et/ou une sanction financière (amende) et ce sans remboursement du montant de sa participation et/ou de sa caution.
Communication et média:
l’organisateur est susceptible de faire des photos et des vidéos durant l’événement et de les utiliser ensuite à des fins promotionnelles et marketing.
L’exposant donne son accord pour que son image et son nom soient utilisés à des fins de publicité et de promotion sans qu’aucune rémunération ou compensation ne soit exigible. En ayant donné son accord, l’exposant est réputé avoir recueilli l’accord de ses salariés et de l’utilisation éventuelle de leur image par l’organisateur.
Détérioration, dégâts et infractions:
L’exposant s’engage à indemniser le propriétaire du site,
la ville, la commune, l’organisateur, les bénévoles, le personnel de l’organisateur, les sous-traitants, etc. pour tout dommage causé par l’exposant ou ses préposés à des personnes, immeubles, meubles, véhicules ou équipements, sur simple présentation du relevé des dégâts.
L’exposant tiendra l’organisateur quitte et indemne de tout recours, poursuite, demande de dommages – intérêt, responsabilité, jugement, frais et dépense (y compris les honoraires normaux de conseils), découlant d’une infraction commise par lui-même ou son personnel, découlant d’un acte de malveillance délibéré, d’une négligence ou d’une omission dans son chef ou d’un membre de son personnel, d’un de ses mandataires ou d’un de ses sous-traitants.
Annulation de participation de l’exposant:
Si pour une raison quelconque, l’exposant annule sa participation par lettre recommandée, les indemnités de résiliation seront les suivantes :
*Résiliation au moins 60 jours avant la manifestation : frais de dossier de 100€.
*Résiliation moins de 30 jours avant la manifestation : 50 % du montant de la participation.
*Si l’exposant n’a pas fait part de sa volonté de résilier son inscription 30 jours avant la manifestation et n’a pas occupé son emplacement à l’ouverture du Festival, il sera redevable du montant total de la participation.
Annulation du festival:
Dans le cas où, pour une raison de force majeure, la manifestation ne pouvait avoir lieu, les exposants s’engagent à ne réclamer aucune indemnité.
Les exposants s’engagent à abandonner toute faculté de recours contre les organisateurs.
L’annulation du festival n’annule pas la dette de l’exposant envers l’organisateur.
L’organisateur peut décider à tout moment – pour des raisons de sécurités ou de météo – de soit modifier les horaires soit de clôturer anticipativement l’événement.
Paiements:
Sauf disposition contraire les emplacements sont payables dès confirmation par l’organisateur.
La confirmation par l’organisateur constitue la commande en bonne et due forme entre les parties.
Confidentialité:
Toutes informations communiquées ou échangées entre l’organisateur et l’exposant, les partenaires, fournisseurs ou sous-traitants dans le cadre de l’événement ou à l’occasion de celui-ci restent strictement confidentielles, sauf les informations que l’organisateur aurait rendues publiques ou les informations normalement accessibles au public.
Compétences de juridiction:
Tout exposant inscrit accepte sans réserve les conditions générales, ainsi que le règlement intérieur. En cas de litige, l’exposant s’engage à adresser une réclamation, dans les dix jours qui suivent la manifestation, à l’organisateur avant d’engager toute procédure à son encontre. Toute réclamation non transmise au-delà de ce délai ne sera pas prise en compte.
En cas de contestation quelconque, le tribunal de Bruxelles, section francophone sera compétent.
L’organisateur se réserve le droit de statuer sur tous les cas qui se présentent et qui n’avaient pas été prévus au règlement intérieur. Il se réserve le droit d’apporter de nouvelles dispositions chaque fois que cela lui semblera nécessaire
L’Exposant s’engage formellement à respecter les consignes de l’organisateur du règlement ainsi que les présentes conditions générales, et reconnaît en avoir pris connaissance. Il en accepte les termes
Service:
*The exhibitor undertakes to offer for sale only the products/services mentioned in his application file and validated by the organiser.
*The exhibitor is not allowed to sell beverages unless expressly notified by the organiser.
*All packaging, dishes and containers used by the exhibitor during the event must be single-use (except for returnable cups) and biodegradable. The exhibitor undertakes to recycle and minimise the waste he generates on the site.
*No sound equipment may be brought in by exhibitors, unless authorised in writing by the organiser. In this case, all costs will be charged to the exhibitor (copyright, …).
*The exhibitors must ensure the service during the whole Festival, out of respect for the public.
Location:
During the installation on the day of the event, place will be allocated according to the advice of the organiser and the exhibitor is obliged to respect the instructions so as not to disturb the smooth running of the installation.Pitches that have not been occupied by the end of the installation on the first day may be allocated to any other exhibitor without the signatory of this participation commitment being able to claim reimbursement of the amount of his participation or any compensation.
Inspections:
The exhibitor may be subject to controls (police, fire brigade, Belgian Food Regulation, etc.).
The instructions of these inspections must be complied with immediately.
The organiser may also carry out checks on compliance with the rules and regulations accepted by the exhibitor.
In the event of infringement, penalties may be imposed by the organiser (see § penalties).
It is the responsibility of each exhibitor to complete the customs formalities for materials and goods from abroad, as well as for local VAT and sales authorisation. The organiser cannot be held responsible for any difficulties that may arise as a result.
Surveillance & security:
During opening hours and during installation and dismantling, the exhibitor is responsible for the surveillance of his material. The exhibitor undertakes to be present from the opening until the complete evacuation of the festival site.
The exhibitor is obliged to take note of and respect the safety measures imposed by the public authorities and those taken by the organiser.
Likewise, the exhibitor is obliged to scrupulously respect the internal order measures for the event or any police measures prescribed not only by the organiser, but also by any other competent authority.
The organiser, his staff or the competent authorities (police, fire brigade, fasfc, etc.) reserve the right to suspend the Exhibitor’s participation at any time and to withdraw his access if he fails to comply with any or all of the articles in these General Conditions.
Cleaning:
The Exhibitor is responsible for cleaning his site. On dismantling, he must also leave a clean space free of all clutter, including rubbish bins!
Electricity:
The exhibitor has access to an electrical connection – by default 1x 220V 16A max 3000w and located less than 50m from his stand. This is an obligation of means and not of result.
The exhibitor is responsible for his connection (cable and adapter). An electrician will check the conformity of the equipment!
All electrical and gas equipment used by the exhibitor must comply with the applicable standards.
The organizer cannot be held responsible for any power cuts that may occur.
Insurance:
Exhibitors are required to insure the equipment, furniture and goods they exhibit and to take out a civil liability policy, including food poisoning, for the duration of the event, including delivery, installation and dismantling.
The organiser declines all responsibility for damage or loss, as well as for theft or disappearance of equipment belonging to exhibitors.
Penalties:
Failure to comply with the clauses of these regulations may, at the sole discretion of the organiser, even without formal notice, result in the immediate exclusion (temporary or permanent) of the exhibitor and/or a financial penalty (fine) and this without reimbursement of the amount of his participation and/or his deposit.
Communication and media:
The organiser may take photos and videos during the event and use them for promotional and marketing purposes.
The exhibitor agrees that his/her image and name may be used for publicity and promotional purposes without any remuneration or compensation being due. By agreeing to this, the exhibitor is deemed to have obtained the agreement of his employees and the possible use of their image by the organiser.
Deterioration, damage and infringements:
The exhibitor undertakes to compensate the owner of the site,
The exhibitor undertakes to compensate the owner of the site, the town, the municipality, the organiser, the volunteers, the organiser’s staff, the subcontractors, etc. for any damage caused by the exhibitor or his employees to persons, buildings, furniture, vehicles or equipment, upon presentation of the damage report.
The exhibitor shall indemnify and hold harmless the organiser from and against all claims, actions, damages, liabilities, judgments, costs and expenses (including normal consultancy fees) arising out of any offence committed by the exhibitor or its staff, arising out of wilful misconduct, negligence or omission on the part of the exhibitor or its staff, agents or subcontractors.
Cancellation of participation by the exhibitor:
If for any reason the exhibitor cancels his participation by registered letter, the cancellation fees will be as follows:
*Cancellation at least 60 days before the event: €100 handling fee.
*Cancellation less than 30 days before the event: 50% of the participation fee.
*If the exhibitor has not given notice of his wish to cancel his registration 30 days before the event and has not occupied his space by the opening of the Festival, he will be liable for the full amount of the participation.
Cancellation of the festival:
In the event that, for reasons of force majeure, the event cannot take place, the exhibitors undertake not to claim any compensation.
The exhibitors undertake to waive any right of recourse against the organisers.
The cancellation of the festival does not cancel the exhibitor’s debt to the organiser.
The organiser may decide at any time – for security or weather reasons – to either change the timetable or to close the event early.
Payment:
Unless otherwise agreed, pitches are payable upon confirmation by the organiser.
Confirmation by the organiser constitutes the order in good and due form between the parties.
Confidentiality:
All information communicated or exchanged between the organiser and the exhibitor, partners, suppliers or subcontractors within the framework of the event or on the occasion of the event remains strictly confidential, except for information that the organiser has made public or information normally accessible to the public.
Jurisdiction:
All registered exhibitors accept without reservation the general conditions, as well as the internal regulations. In the event of a dispute, the exhibitor undertakes to send a complaint to the organiser within ten days of the event before initiating any proceedings against him. Any complaint not sent after this period will not be taken into account.
In the event of any dispute, the court of Brussels, French-speaking section, will be competent.
The organiser reserves the right to rule on all cases which arise and which have not been provided for in the internal regulations. It reserves the right to introduce new provisions whenever it deems necessary.
The Exhibitor formally undertakes to respect the instructions of the organiser of the regulations as well as the present general conditions, and acknowledges having read them. He accepts the terms
